DE-DE Group, LLC and our affiliates (collectively, “DE-DE” or “we,” “our,” or “us”) respect the privacy rights of our users and we are committed to protecting the information collected from you through our Birdseye App, www.birdseyemail.com, and the services, features, and content we offer (collectively, the “Services”). In furtherance of our commitment, we have adopted this Privacy Policy that guides how we collect, use, and disclose the information you provide to us through the Services. This Privacy Policy describes:

1. The information we collect, how we do so, and the purposes of our collection.
2. How we use and with whom we share such information.
3. How you can access and update such information.
4. The choices you can make about how we collect, use, and share your information.
5. How we protect the information we store about you.

By using the Services, you agree that your personal information will be handled as described in this Privacy Policy. Your agreement takes place when you “accept” or “allow” (or similar terms) the Birdseye App or otherwise use any part of the Services. It is your responsibility to read and accept the terms of service and privacy policy for your application store as well as your mobile or Internet service provider. We are not responsible for the privacy practices of other entities through which the Services are offered or to which the Services may be connected, such as the Apple App Store, the iPad®, and the Google Gmail™ email service. This Privacy Policy applies solely to information collected by us in connection with your use of the Services. We may revise or update this Privacy Policy at any time by posting an announcement on the Services or by sending you an email, and we encourage you to check back often to ensure that you are familiar with the most recent version and the terms of our Privacy Policy. This Privacy Policy is part of the Birdseye™ Terms of Use; capitalized terms not defined in this Privacy Policy have the meanings specified in the Terms of Use. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used, and users are bound by any change to the Privacy Policy when he or she uses the Services after such changes have been posted.

1. Information We Access and/or Collect.
   1. Information Received from Your Application Store or Device. When you download the Birdseye App and/or use the Services, you allow us to access and store the following information, as allowed by you and your preferences on your mobile device:
      • Your device technical information (e.g., the type of device you are using, the operating system version, etc.);
      • Your IP address;
      • Certain statistics about usage of the Services (e.g., number of emails received and sent through the Services, etc.) that are collected anonymously and/or in the aggregate
      When you use the Services, you also allow us to access and store certain data relating to your email contacts, which will be stored and used only temporarily to allow us to provide certain features of the Services.
      The bulk of this information is collected and stored through the use of web logs, which are files on our web servers that record actions taken on the Services.
   2. Linked Third Party Services. Our Services may also allow you to incorporate or display your profile information and content from third party services. For example, our Services may enable you to automatically transmit or display information (such as emails in your inbox) from your email accounts to your mobile device or tablet. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to a third party website or business, please review all such business’ or websites’ policies. In order to link your Services account with any third party account, we may ask you for account information for those services. If you provide your third party account credentials to us, you understand that content and/or information in those accounts may be transmitted into or displayed through your account with us, and that third party account information transmitted to our Services is covered by this Privacy Policy. We don’t actually store your passwords for those third party accounts. Instead, we just use an authentication token to verify your user name.
   3. Other Information You Provide Us. You may choose to provide us with certain other information. If you join a discussion or offer comments on public areas of our website, or contribute content on or through the Services, your user name or email and any such comments or other content you provide may be publicly displayed.
   4. Customer Support Correspondence. When you ask for assistance from our customer support team, we will collect and store the contact information you provide, any other information you provide, as well as information about your activity on the Services. We will also store the correspondence and any information contained within it. You acknowledge and consent to the storage of these communications.
   5. Third Party Services. We do not collect any personally identifiable information about you via the Services except as otherwise set forth herein. As a convenience to you, the Services contain functionalities that may allow you to connect to Third Party Services (such as the Google Gmail™ email service) or to otherwise share information and other materials. You are solely responsible for any information or content you share (and the consequences of such sharing). We exercise no control over the information practices of Google or any other Third Party Services. Access to and use of Third Party Services is at your sole risk.
2. How We Use the Information We Collect.
   We may use the information we collect about you in any one or more of the following ways:
   • To register your account and allow you to use the Services.
   • To administer the Services.
   • To provide technical support and respond to user inquiries.
   • To prevent fraud.
   • To notify users of Services updates.
   • To solicit input and feedback to improve our products and services and customize your user experience.
   • To resolve disputes and troubleshoot problems.
   • To analyze trends and user traffic and gather statistical information.
   • To inform users about new products and promotional offers.
   • To investigate and enforce terms of use or legal violations.
   Additionally, we (and our third-party service providers and designees) parties may use the information we collect, such as your email address if you provide it to us, to (i) respond to customer support inquiries and (ii) keep you informed of your Services activity.
3. How We Share Information.
   We do not use or sell your personal information to third-party advertisers. We only use and share your personal information as allowed in this Privacy Policy above and as follows.
   1. Our Third Party Service Providers. We may use and share your personal information with third parties that we use to perform services on our behalf, such as data analysis, email delivery, hosting services, customer service, and marketing. We require all such entities to agree to maintain the confidentiality of your personal information and not to use your personal information for any other purpose.
   2. Compliance with Law and Sale and Merger. We may also access, read, preserve and disclose personal information if we have a good faith belief that (i) we are required to do so by law, regulation, or government request, (ii) it is reasonably necessary to enforce our Terms of Use or this Privacy Policy, including investigation of potential violations thereof or hereof, or to detect, prevent or otherwise address fraud, security or technical issues, or (iii) doing so is reasonably necessary to comply with legal processes, respond to any claims, or to protect the rights, property or personal safety of DE-DE, our customers, or the public. This includes exchanging information with other companies and organizations for fraud protection and spam/malware prevention. In addition, if we seek to undertake a business transaction relating to the Services or our business in general, such as a bankruptcy, merger, sale, transfer of company assets, acquisition, or similar event, we may disclose and/or transfer information about our customers, including personal information, in accordance with applicable law. You acknowledge that such transfers may occur, and that any acquirer of us or our assets may continue to use your information as set forth in this policy.
   3. With Your Consent. Except as otherwise set forth in this Privacy Policy, you will be notified when your personal information may be shared with third parties, and will be able to prevent the sharing of this information.
4. Children’s Privacy. We recognize the importance of safeguarding the privacy of children. To this end, we do not knowingly collect or solicit personal information from children under the age of 13. In the event we learn that we have collected personal information from a child under the age of 13, we will delete that information as quickly as possible. 5. How to Access and Update Your Information. To manage the information DE-DE receives about you, you may follow the instructions in the Services for updating your information and changing you privacy settings. We do not have control over the personal information you provide to your application store or any Third Party Services.

6. Opting Out. You can always choose not to provide certain personal information to us, but doing so may prevent you from being able to use or take advantage of specific features of the Services. If you no longer wish to receive promotional communications from us, you can opt out from receiving such communications from us at any time. You may do so by emailing us at team@birdseyemail.com. We will be happy to honor your request. However, regardless of your contact preferences, we reserve the right to contact you when we believe it is necessary, such as for account recovery purposes.
7. Security of Your Information. The security and confidentiality of your personal information is extremely important to us. We have implemented technical, administrative and physical security measures designed to protect your personal information from unauthorized access and improper use. In an effort to prevent unauthorized electronic access to personal information, we maintain information collected online behind a firewall-protected server; use SSL encryption for purchases made through the Services; limit access only to those employees performing a legitimate business function; and, if you have provided us with your email address and as required by law, notify you if we learn a breach has occurred.
   However, please understand that we cannot guarantee that unauthorized access, hacking, data loss, or other breaches will never occur. Although we strive to protect your personal data, we cannot guarantee the security of your data while it is being transmitted to our site and any transmission is at your own risk. In addition, we urge you to take steps to keep your personal information safe.
8. Customers Outside the United States. By using the Services, customers outside of the United States understand and agree that DE-DE is a company based in the United States with servers based in the United States, and that personal information will be transferred to, processed and maintained on computers located in the United States, where the privacy laws may be different than those in your jurisdiction.
